Terms of Service

1. Acceptance of Terms

By accessing or using aigency (“Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service. We may update these Terms at any time by posting the revised version on this page. Your continued use after changes are posted constitutes acceptance.

2. Description of Service

aigency is a software-as-a-service platform that uses artificial intelligence to analyze websites and generate marketing strategies, content suggestions, and performance scores. The Service is provided for informational purposes only and does not constitute professional marketing, legal, financial, or business advice.

3. Eligibility

You must be at least 18 years old and capable of forming a binding contract under applicable law to use the Service. By using aigency, you represent and warrant that you meet these requirements.

4. Accounts

Some features require an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to notify us immediately of any unauthorized use. We reserve the right to suspend or terminate accounts that violate these Terms.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law
  • Attempt to reverse-engineer, decompile, or disassemble any part of the Service
  • Interfere with or disrupt the Service or servers connected to it
  • Scrape, crawl, or use automated means to access the Service beyond normal use
  • Resell, sublicense, or redistribute Service outputs without authorization
  • Submit content that infringes the intellectual property rights of others

6. AI-Generated Content

The Service uses artificial intelligence models to generate analysis and content. AI outputs may be inaccurate, incomplete, or unsuitable for your specific circumstances. You acknowledge that:

  • AI-generated content is provided “as is” without any guarantee of accuracy
  • You are solely responsible for reviewing, editing, and verifying all outputs before use
  • aigency is not liable for any consequences arising from your reliance on AI-generated content
  • Outputs do not constitute professional advice of any kind

7. Intellectual Property

All content, features, and functionality of the Service (excluding user-submitted content and AI outputs generated for you) are owned by aigency and protected by United States and international intellectual property laws. You retain ownership of content you submit to the Service. You grant aigency a limited, non-exclusive license to process your submitted content solely to provide the Service.

8. Payment and Subscriptions

Paid plans are billed on a recurring basis (monthly or annually) through our payment processor, PayPal. By subscribing, you authorize recurring charges until you cancel. You may cancel at any time; cancellation takes effect at the end of the current billing period. Refunds are not provided for partial billing periods unless required by applicable law.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT AI-GENERATED CONTENT WILL BE ACCURATE OR COMPLETE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AIGENCY AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless aigency from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination (including disclaimers, limitation of liability, and indemnification) will survive.

13. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to conflict of law principles. Any dispute arising under these Terms shall be resolved exclusively in the state or federal courts located in Travis County, Texas.
